 Ferrari Seeks Court Injunction Against FIAs 2010 F1 Rules

Ferrari has stepped up the budget cap row by applying for an injunction in the French courts against the 2010 rules.

FIA president Max Mosley, who met with the F1 teams and Bernie Ecclestone at a Heathrow hotel on Friday, revealed the news as he emerged from the meeting.

Ecclestone also emerged from the meeting, as the FOTA group headed straight back into talks.

"The teams have gone off to see if they can come up with something better than the cost cap," Mosley told reporters. "We are prepared to listen to what they have to say."

He said the meeting was "friendly", but added: "It became apparent that Ferrari have made an application to the French courts to apply for an injunction to stop us doing what we want to do."

Mosley said he had not agreed to compromise on his plans, and that he doubts Ferrari will actually quit the sport.

LoL By the way how comes that both Max and Bernie are ruling FIA for such a long time? Is FIA a democratic dictatorship? Because it feels really like a Bananian Republic, where the (maybe) democratically elected president is ruling in a totalitarian way until the end of his life or another coup d'?tat...

I sure hope Ferrari, BMW, Red Bull and Renault all go to Lemans. F1 is a bit out there anyhow. I don't see any open wheel cars on the highway.

Never seen an R10 going to get groceries either... I wonder under what grounds they wanna take FIA to court? Since FIA is the ruling body...then...they can do whatever they want, no?

It seems strange, by taking FIA to the french court, then where did spy gate between Ferrari & Mclaren {last year} go? & Lie gate from Mclaren driver go? I mean like, what non sense is this?

my god ferrari if your going to pull out, just pull out! stop dragging it out! lol no body cares any more, you need F1 just as much as F1 needs ferrari, so FIA stand your ground and watch them come crawling back! honestly either build a quicker car and stop moaning about budget caps! brawn GP basically didnt exist until 2 months before the Aus GP and they are winning, chances are that they didnt manage to spend more than 40m in that time... so please ferrari, stop being the big kid in the playground, who needs to pick on something to be satisfied, and start getting down to business... that business being building a Lemans car!

Honda last year spent $400million developing the current BrawnGP car, so you can't say that Brawns success shows in any way what is possible with $40million cap. Wait two years when they need to redevelop a new car, and then make the call.

If you're not aware of Ferrari's argument here is it- placing a budget cap on a team will hurt the sport. 1) It takes HUNDREDS of millions of dollars to develop a Formula 1 car, it's a nine figure job. 2) Formula 1 is the first ground for all new cutting edge technology that bleeds down to the entire automotive industry- traction control, ABS, the list goes on and on... if you limit development, it'll hurt technological advancements in the industry. Car manufacturers lust after Formula 1 because it is a sport but also a chance to play mad scientist. Finally, it's not just Ferrari doing this, there are about 7 teams on the same page, Ferrari is getting the spotlight because it's the most significant team in Formula 1 history

which is my point... they arent about to drop out of the sport! so ur saying that choking F1 will choke the automotive industry? there have been many motoring advancements that were not pioneered in F1 cars such as pretty much every safety feature (air bags, crumple zones ect.)... which makes up a fair percentage of sales in ordinary cars.. its not like companies will stop testing the latest technology for their road cars purely cause it wasnt done in F1 due to budget caps!? everyone should just play by the rules... even if they change, mix up the standings and results! i must really be the only one who enjoys F1 as it is now with the typically "successful" teams not being so great... it makes for much better watching! i think budget caps will help to build on this! and if this makes mosely more money in advertising + TV rights, good on him. this is just a business after all!

By the way, Max Mosley is doing this because there is big money involved in advertisement behind Formula 1, and making the sport more competitive (by leveling the play field) allows more advertising money in the sport.

Imagine a rival league with uncapped teams that have unlimited resources at their disposal, with the inclusion and return of new, more competitive teams. Imagine a league pitting: Scuderia Ferrari Marlboro, Minardi Lamborghini, Penske Porsche, Vodafone McLaren Mercedes, Audi, BMW Sauber, ING Renault, Red Bull Renault, AT&T Williams Toyota, Panasonic Toyota Lexus. We would also have a reshuffle in the driver's cockpits, with the return of some drivers and transfer of other current ones. Michael Schumacher & Felipe Massa at Scuderia FERRARI Marlboro, Fernando Alonso & Jacques Villinueve at Minardi LAMBORGHINI, Kimi Raikkonen & Mika Hakkinen at Penske PORSCHE, Lewis Hamilton & Nico Rosberg at Vodafone McLaren Mercedes, Juan Pablo Montoya & Jenson Button at Brawn Mercedes, Pedro de la Rosa & Bruno Senna at Audi and Aguri Suzuka & Takuma Sato at Panasonic Toyota Lexus . effington, With all due respect, you do not see the larger picture. A car is more than airbags and crumple zones. It also has mechanical parts and these parts are built with certain materials. The manufacturing process is borrowed from F1. See BMW 335i engine using super light material used by the BMW F1 team. Brake discs, on AMGs, on M3s, M5s are similar to F1. Gearboxes, the SMG I, SMGII on M3e46, the DCT on e92 is from F1. So on and so forth. F1 is vital for manufacturers with premium models.

What a fools. FIA is trying make a suggestion how car should be built by ruling and modifying rules. They can do this because they are shown to the whole motoring world even this how and in what way we should get a laid.

They should just split. Bernie Ecclestone, Max Mosley and the FIA should remain with the teams that subscribe to their ideals, while those that don't agree move on and craete their own league which will be independent of FIA Politics and meddling! Thats the best solution, because even if they manage to resolve this issue there'll be more issues in future, because the problem is the way the FIA DICTATES and doesn't consult! The FIA and the disgruntled teams should just go their separate ways! Then we'll have the FIA F1 and FOTA League 1 GP. Just like there's an A1 GP Championship.

How will this play out? I'm no fortune teller, but if I was a betting man, here's how I'd stack it: 1) The FIA and the teams reach a compromise, albeit a very sensitive and vulnerable one 1:2 2) The major teams break away, at least for a while, with the FIA giving in and the teams rejoining under their own conditions 1:5 3) The major teams break away, forming a new rival series that steals the show from the FIA governed F1 formula. F1 eventually dies a sad and relatively inconspicuous death 1:10 4) The major teams break away, forming a new, but unsuccessful rival series that dies within a couple of seasons 1:12 5) Max and Bernie are bungled, finally, out of the sport. F1 and its no-more-decreasing fanbase live happily ever after 1:100000 6) Everyone gets fed-up with the politics, unneeded drama and sensationalism with the formula and start watching other things like Nascar, ballet and soap operas instead 1:500000 4)

The FIA and FOTA need to come to an agreement - both of them. The FIA is not listening and is becoming a dictatorship were the citizens (teams) have no say. F1 needs to have a governing body which regulates and puts forth a set of rules for all teams to follow. Mosley in my opinion needs to step down and let someone with a wider view take over.

Everyody within Ferrari are like babies. As soon as they don't get what they want, they start crying. Perhaps they can concentrate more on the sport (and finding a potential world champion driver) than court sessions etc. Better for them and better for the sport.
